If you have been arrested for DUI and have a prior DUI conviction, then it is possible that you were fitted with a transdermal monitoring device. Sometimes referred to as a SCRAM device, these devices monitor alcohol consumption and send a signal to the SCRAM provider. If you drink while fitted with a SCRAM device, then it is a violation of your bond conditions and you will be re-arrested.
Although these devices may be appropriate in some cases, they are costly (around $400 per month) and sometimes are not appropriate for your particular case. If a magistrate fits you with a SCRAM device, please contact my office to determine whether we can get the device removed.
Usually, removal of a SCRAM device requires filing a motion before the general sessions court. The purpose of a SCRAM device is to get hardcore alcoholics over the "hump" of having to be alcohol-free for a period of time. However, these devices are being used to punish offenders before they are proven guilty. Nobody should be forced to wear a SCRAM for four months while waiting for the TBI to finish their blood alcohol analysis. If you are fitted with a SCRAM device, contact an attorney that can help you determine whether you need the device. It could save you hundreds of dollars in fees.
